What does OSHA stand for?

OSHA stands for ‘Occupational Safety and Health Administration’ and it is a part of the United States Department of Labor.

Do I have to comply with OSHA regulations even though I’m a very small office?

Under the OSH law, employers have a responsibility to provide a safe workplace.  Regardless of an employer’s education, training or licensing, if an employer has one or more employees, then he or she must comply with the Occupational Safety and Health Act of 1970, 29 USC 654 (a) Each employer –(1) shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees; (2) shall comply with occupational safety and health standards promulgated under this Act. (b) Each employee shall comply with occupational safety and health standards and all rules, regulations, and orders issued pursuant to this Act which are applicable to his own actions and conduct.

How often does OSHA conduct inspections and do they give you advance notice?

OSHA inspections are conducted without advance notice.

There are millions of workplaces in OSHA’s jurisdiction; therefore, it is impossible for OSHA to inspect every single business routinely. Based on this factor OSHA places focus on hazardous workplaces, and has outlined the order of priority as follows:

  1. Imminent danger situations
  2. Severe injuries and illnesses
  3. Worker complaints
  4. Referrals
  5. Targeted inspections
  6. Follow-up inspections

(OSHA prioritizes complaints based on severity and may conduct an investigation by means of written notice sent by mail to the business for lower-priority hazards.)

Can OSHA issue costly citations?

OSHA has conducted inspections at Dental, Medical, Veterinary facilities as well as all types of businesses involving various exposures to chemicals and Bloodborne Pathogens and will continue to conduct these inspections as warranted. Citations from recent inspections of offices have recorded violations of the Hazard Communication standard, Injury and Illness prevention program as well as several other OSHA standards, including 29 CFR 1910.1030, Bloodborne Pathogens; 29 CFR 1910.132, General Requirements (personal protective equipment); 29 CFR 1910.133, Eye and Face Protection; and 29 CFR 1910.303, General (electrical).

How much are Cal/OSHA citations and penalties for 2020?

Cal/OSHA has been increasing the penalty amounts over the past few years. The following is a summary of the most common penalty amounts:

  • Regulatory violations: New penalty is $13,277 maximum per violation.
  • General violations: New penalty is $13,277 maximum per violation.
  • Serious violations: New penalty is $25,000 maximum per violation.
  • Willful & Repeat violations: New penalty is $132,765per violation.

The amount of the maximum penalties has increased substantially over the past few years but the cost of a violation can include far more than the penalty issued by Cal/OSHA. A Cal/OSHA citation can also increase the employer’s exposure for workers compensation claims.

Can I refuse entry to an OSHA inspector?

An employer can refuse an investigation if the inspector does not arrive with a warrant to conduct the search. Accordingly, OSHA can be compelled to provide a warrant for a search if an employer requests it. Requiring the inspector to come back with a warrant, however, may arouse unnecessary suspicion. Is the state of California governed by Federal OSHA or its own state OSHA program?

As you are aware the State of California operates its own occupational safety and health program under a plan approved and monitored by federal OSHA. (Cal/OSHA). Employers in the State of California must comply with state occupational safety and health requirements. As a condition of plan approval, state plans are required to adopt and enforce occupational safety and health standards that are at least as effective as those put into effect by federal OSHA, and to interpret these standards as effectively as federal OSHA does its own standards.
